Welcome to eBid Mart! These Terms and Conditions ("User Agreement") govern your access to and use of eBid Mart’s marketplace, mobile applications, websites, tools, and other services (collectively, the "Services"). By accessing or using our Services, whether as a buyer or seller, you agree to comply with and be bound by this User Agreement, our payment agreement, all policies, and any additional terms posted on or incorporated into our Services. Please read these terms carefully. If you do not agree with any part of these terms, do not use our Services. 1. Acceptance of Terms By registering for an account, browsing listings, buying or selling items on eBid Mart, you acknowledge that you have read, understood, and agreed to be legally bound by this User Agreement and our policies. This includes but is not limited to: Our Privacy Policy Payment Agreement Community Guidelines Any other relevant policies posted on the platform These documents form an integral part of your agreement with us. 2. About eBid Mart eBid Mart is a smaller online marketplace designed to connect buyers and sellers in a secure environment. We provide the platform and tools necessary for users to list items for sale or purchase goods from others. We are not the seller or buyer of any items listed on the platform; transactions are conducted directly between users. 3. Eligibility To use eBid Mart Services, you must: Be at least 18 years old or have reached the age of majority in your jurisdiction Have full legal capacity to enter into contracts Provide accurate and complete information when creating your account 4. Account Registration & Security When you create an account on eBid Mart: You agree to provide current, accurate information about yourself. You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately if you suspect unauthorized use of your account. We reserve the right to suspend or terminate accounts that violate these terms or engage in fraudulent activity. 5. Use of Services As a user on eBid Mart: Buyers may browse listings, place bids or purchase items where applicable. Sellers may create listings describing their items accurately and honestly. You agree not to use our Services for unlawful purposes or activities that violate any applicable laws or regulations. Prohibited conduct includes but is not limited to: misrepresentation of products, fraudulent transactions, spamming other users, infringing intellectual property rights. 6. Transactions & Payment Agreement All transactions occur between buyers and sellers directly through our Services. Payment methods accepted will be specified during checkout; users must comply with applicable payment agreements. We do NOT share any payment information with third parties except as required by law or as necessary for processing payments securely (e.g., payment processors). Users are responsible for ensuring timely payment and shipment of purchased items according to agreed terms. eBid Mart does not guarantee transactions nor take responsibility for disputes arising between buyers and sellers; however, we encourage users to resolve issues amicably through communication or mediation channels provided. 7. Personal Data Collection & Privacy We collect personal data when you: Register for an account or update profile information Use our Services including browsing listings and making purchases Participate in community discussions or submit web forms Additionally, we may collect personal data from third-party sources such as affiliated companies within the eBid Mart network, credit agencies/bureaus, payment providers, and other data suppliers. Your privacy is important to us: We do NOT share your payment information with any external parties other than trusted payment processors under strict confidentiality agreements. Your personal data will be handled according to our Privacy Policy which is incorporated herein by reference. We employ industry-standard security measures to protect your data but cannot guarantee absolute security. By using our Services, you consent to the collection and use of your personal data as described above. 8. Intellectual Property Rights All content on eBid Mart including logos, text, images, software code (“Content”) is owned by eBid Mart or its licensors unless otherwise stated. Users retain ownership over their own listings’ content but grant us a worldwide license to display it on our platform during the term it is posted. You agree not to copy, reproduce, modify or distribute any Content without explicit permission from the rightful owner. 9. Disclaimers & Limitation of Liability Our Services are provided “as is” without warranties of any kind. We do not guarantee: The accuracy or reliability of listings posted by users That transactions will be completed satisfactorily To the fullest extent permitted by law: eBid Mart shall not be liable for indirect damages arising out of your use of the platform including loss of profits
